Bro Glo offers this website, including all information, tools, products, and services available from thebroglo.com (the "Site") to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting the Site and/or purchasing products from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service," "Terms"), including any additional terms, conditions, and policies referenced herein or available by hyperlink. These Terms of Service apply to all users of the Site, including without limitation users who are browsers, customers, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using the Site. By accessing or using any part of the Site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the Site or use any of our services.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Section 1 - Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this Site.

You must not transmit any worms, viruses, or any code of a destructive nature.

A breach or violation of any of these Terms will result in an immediate termination of your access to our Services.

Section 2 - General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any content on the Site through which the Service is provided, without express written permission from us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Section 3 - Product Information, Descriptions, and Cosmetic Disclaimers

Bro Glo products are cosmetic self-tanning products intended for external use only. Our products are not drugs, medical devices, or sunscreen. They do not provide protection from ultraviolet (UV) radiation. You should continue to use appropriate sun protection regardless of whether you are using our products.

Skin Sensitivity and Allergies: As with any cosmetic product applied to the skin, individual results may vary. We strongly recommend performing a patch test on a small area of skin at least 24 hours before full application, especially if you have sensitive skin, allergies, or a history of skin reactions. If irritation, redness, swelling, or any adverse reaction occurs, discontinue use immediately and consult a healthcare professional.

Color Results: Self-tanning results vary based on individual skin tone, skin type, application technique, and product used. The color results shown on our Site (including product photos, before-and-after images, and user-generated content) are for illustrative purposes only and may not represent the exact results you will achieve. We make no guarantee regarding the specific shade, depth, or longevity of any tan produced by our products.

Product Accuracy: We have made every effort to display as accurately as possible the colors, textures, and appearance of our products on the Site. We cannot guarantee that your computer monitor, phone screen, or other display device will accurately render the actual color of any product.

Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Nothing on this Site should be construed as medical advice.

We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products that we offer. All descriptions of products and product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product made on this Site is void where prohibited.

Section 4 - Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we change or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made through the Site. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

Section 6 - Shipping and Delivery

Bro Glo ships from our warehouse in Illinois, United States. Estimated delivery times are provided at checkout and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather events, natural disasters, or other circumstances beyond our reasonable control.

Risk of loss and title for products purchased from the Site pass to you upon delivery of the items to the carrier. If a package is marked as delivered by the carrier but you did not receive it, you should first contact the carrier directly. While we are happy to assist, we are not responsible for packages lost or stolen after delivery confirmation by the carrier.

The Bro Glo name, logo, taglines, product names, and all related names, logos, product and service names, designs, and slogans are trademarks of Bro Glo or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Site without our express prior written consent, except as may be permitted by applicable law.

Section 9 - User-Generated Content

If you submit, post, or otherwise provide any content to us - including product reviews, photos, videos, testimonials, comments, suggestions, ideas, or other materials (collectively, "User Content") - whether through the Site, social media, email, or any other channel, you agree to the following:

You grant Bro Glo a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform your User Content in any media format and through any media channel, including for marketing, advertising, and promotional purposes.

You represent and warrant that you own or have the necessary rights and permissions to grant the license above, and that your User Content does not violate the rights of any third party.

You agree that your User Content will not contain material that is defamatory, obscene, abusive, or otherwise objectionable, and will not contain any computer virus or malware.

We are under no obligation to maintain any User Content in confidence, pay compensation for any User Content, or respond to any User Content.

We may, but have no obligation to, monitor, edit, or remove User Content that we determine, in our sole discretion, to be unlawful, offensive, threatening, defamatory, or otherwise objectionable, or that violates any party's intellectual property or these Terms of Service.

COSMETIC PRODUCT DISCLAIMER: Without limiting the generality of the foregoing, we make no warranties regarding the results you may achieve from using our self-tanning products, including but not limited to the color, shade, evenness, longevity, or appearance of any tan. Self-tanning results are inherently subjective and vary based on individual skin type, tone, preparation, and application technique. Any before-and-after images or testimonials displayed on the Site reflect individual experiences and are not guaranteed outcomes.

In no case shall Bro Glo, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content or product posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.

MAXIMUM LIABILITY: To the fullest extent permitted by applicable law, our total aggregate liability to you for all claims arising out of or related to these Terms, the Service, or any product purchased through the Service shall not exceed the total amount you paid to us for the specific product or order giving rise to the claim.

Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions our liability shall be limited to the maximum extent permitted by law.

Section 15 - Indemnification

You agree to indemnify, defend, and hold harmless Bro Glo and our parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, your use of any product purchased through the Site, your User Content, or your violation of any law or the rights of a third party.

Section 16 - Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Informal Resolution: Before initiating any formal dispute resolution proceeding, you agree to first contact us at support@thebroglo.com and attempt to resolve the dispute informally for at least thirty (30) days. Most concerns can be resolved this way.

Binding Arbitration: If we are unable to resolve a dispute informally, you and Bro Glo agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service, the Site, or any product purchased through the Site (collectively, "Disputes") shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring individual claims in small claims court if they qualify.

Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator. The arbitration shall be held in the State of Illinois, or at another mutually agreed location, or may be conducted via telephone or video conference if appropriate.

CLASS ACTION WAIVER: You and Bro Glo agree that any Disputes shall be resolved on an individual basis only, and not as part of any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

Opt-Out Right: You have the right to opt out of this arbitration provision by sending written notice of your decision to opt out to support@thebroglo.com with the subject line "Arbitration Opt-Out" within thirty (30) days of first accepting these Terms. If you opt out, both you and Bro Glo may pursue claims in court.

Section 17 - Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

Section 18 - Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using the Site.

If, in our sole judgment, you fail or we suspect that you have failed to comply with any term or provision of these Terms of Service, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. We may also deny you access to our Services (or any part thereof).

Section 19 - Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on the Site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including but not limited to any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
